EMERGENCY AND NO MEDICAL ADVICE

NO PHYSICIAN–PATIENT RELATIONSHIP
Your use of the Site—viewing pages, reading content, using tools, or submitting forms—does not create a physician–patient relationship with Roy Kim, MD, or the practice. A physician–patient relationship is established only through direct consultation and a mutual agreement for care.
ELIGIBILITY AND GEOGRAPHIC NOTICE

Licensure: Dr. Kim practices in California. Professional services are provided only where legally permitted and where proper licensure is maintained. The Site is intended primarily for U.S. residents, with a focus on California.

INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Roy Kim, MD and the practice (including physicians, officers, directors, employees, agents, and affiliates) from claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of:

(b) your violation of these Terms;
(c) your violation of law or third-party rights; or
(d) content you submit.
This provision is separate from any medical malpractice coverage.
TERMINATION
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms, security concerns, or business needs. Upon termination, your right to use the Site ceases immediately. Sections that by nature should survive (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive termination.
GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in San Francisco County, California for any dispute not subject to arbitration.Optional ADR provision (choose with counsel):
Mediation first: The parties will attempt in good faith to resolve disputes through non-binding mediation before commencing litigation or arbitration.
Arbitration: Except for claims seeking injunctive relief, disputes may be resolved by binding arbitration administered by JAMS under its rules, before a single arbitrator with healthcare law experience, with judgment on the award entered in any court of competent jurisdiction.
CHANGES TO THE TERMS
We may modify these Terms by posting an updated version with a new Last Updated date. Material changes will be noted on this page. Your continued use of the Site after changes become effective constitutes acceptance.
SEVERABILITY AND ENTIRE AGREEMENT
If any provision is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy (and, where relevant, our HIPAA Notice of Privacy Practices), constitute the entire agreement between you and us regarding Site use.
